Welcome to Book2Color ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Book2Color website, SaaS software platform, and AI-powered coloring book generation tools (collectively, the "Service"). By creating an account, accessing, or using our Service, you agree to be bound by these Terms in full.

1.Acceptance and Legal Capacity

By accessing Book2Color, you represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction), or at least 13 years old with the express consent and supervision of a parent or legal guardian. If you use the Service on behalf of a company or entity, you represent that you have legal authority to bind that entity to these Terms.

2.Description of Service

Book2Color is a SaaS platform providing digital tools and AI models for self-publishers, illustrators, and Amazon KDP authors. Our Service includes:

AI-powered coloring book illustration generation
Interior page editor and layout builder compatible with Amazon KDP print specifications
KDP cover size calculators and generation tools
High-resolution exports (print-ready PDF, PNG)

3.Account Registration & Security

To access core features, you must register an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use or security breach.

4.Plans, Billing & Refund Policy

4.1 Subscription Plans and Billing

We provide free tiers, recurring subscriptions (monthly or annually), and credit packs. Payments are processed securely and encrypted via third-party payment gateways (PayPal, Stripe).

4.2 Refund & Cancellation Policy

AI generation credits incur irreversible compute costs. All refund requests, credit restorations, and subscription cancellations are strictly governed by our dedicated Refund & Cancellation Policy. No monetary refunds apply for subjective dissatisfaction if more than 30% of plan credits have been utilized.

5.Intellectual Property Rights & Commercial License

5.1 User Content & Output Licensing

You retain ownership of any original text prompts, inputs, or assets you upload. Regarding AI-generated outputs:

Paid Subscribers & Credit Packs: You receive full, perpetual, worldwide commercial rights to images and book interiors generated with paid credits. You may sell, edit, distribute, and publish them on Amazon KDP, Etsy, or physical print without additional royalty fees.
Free Tier Users: Content generated on free trial credits is licensed for personal, non-commercial use only.

5.2 Platform Proprietary Rights

The software, codebase, UI, design assets, algorithms, and Book2Color trademarks are proprietary to Book2Color and protected by international intellectual property laws. Reverse engineering, scraping, or copying the platform is strictly prohibited.

6.Acceptable Use Policy

You agree NOT to use the Service to:

Generate illegal, violent, sexually explicit, or defamatory content
Create images that infringe third-party intellectual property or copyright (e.g. unlicensed trademarked characters)
Generate non-consensual depictions of real individuals
Perform scraping, automated bot queries, or disrupt server infrastructure
Resell or redistribute the Service itself without explicit commercial authorization

7.AI Output Disclaimer & Amazon KDP Compliance

Book2Color utilizes probabilistic machine learning models. While optimized for self-publishing:

We cannot guarantee that generated outputs are completely unique or free from accidental similarity to existing works.
You hold sole editorial and legal responsibility to review, verify, and ensure your book complies with Amazon KDP content guidelines or other publisher standards.
Book2Color is not liable for account terminations, blocking, or manuscript rejections imposed by Amazon KDP or third-party marketplaces.

8.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Book2Color shall not be liable for indirect, punitive, consequential damages, lost profits, or estimated publishing royalties.
Our total aggregate liability to you shall not exceed the amount actually paid by you in the 12 months preceding the claim (or a maximum of $100 USD).

9.Indemnification

You agree to defend, indemnify, and hold harmless Book2Color, its officers, employees, and suppliers from any claims, liabilities, losses, damages, or legal fees resulting from your use of the Service, content generated or published by you, or breach of these Terms.

10.Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising hereunder shall first be resolved through good-faith direct negotiations within 30 days. If unresolved, disputes will be submitted to binding arbitration under applicable commercial arbitration rules.
